The California talent agency bond is a $50,000 surety bond required of every licensed talent agency in the state. Under Labor Code § 1700.15, the bond must be deposited with the Labor Commissioner (the Division of Labor Standards Enforcement, part of the Department of Industrial Relations) before a talent agency license is issued — and again before each renewal.

Who Needs a Talent Agency License and Bond?

California’s Talent Agencies Act (Labor Code § 1700 and following) requires a license for anyone who procures, offers, promises, or attempts to procure employment or engagements for artists. That covers agencies representing:

Talent Agency vs. Personal Manager

A talent agency finds work for artists. A personal manager advises and guides a career. The license and bond requirement follows the activity: if you procure employment for artists, you are acting as a talent agency and need a license and the $50,000 bond, whatever you call yourself.

What the Bond Protects

The bond protects the artists an agency represents. Talent agencies often collect money on an artist’s behalf. If the agency fails to comply with the Talent Agencies Act or fails to pay money owed to an artist, a claim can be made against the bond. If the surety pays a claim, the agency must repay the surety — the bond protects the artists, not the agency.

SAG-AFTRA Franchised Agencies

Agencies franchised by SAG-AFTRA need a separate SAG-AFTRA franchise bond on the union’s own form, in addition to the $50,000 state bond. We can place both.

Businesses that charge artists fees for listings, counseling, training, or photos — without procuring employment — fall under a different law and need the fee-related talent service bond instead.

How Much Does It Cost?

You do not pay the full bond amount. You pay a premium — a percentage of the bond amount based mainly on your personal credit and business history. We submit your application to several surety companies, and each sets its own rate, so your premium depends on which surety approves you and isn’t set until you’re approved.
